The terms “we”, “us” and “our” refer to Coastal Art Life. Coastal Art Life operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).
Coastal Art Life is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced in them, constitute our “Terms of Service” or “Terms” and describe your rights and responsibilities when you access or use the Services.

We make reasonable efforts to describe and display our products accurately.
However, colours and product appearance may vary depending on your device, screen settings, lighting conditions and browser configuration.
For artwork, minor variations in colour, texture, scale, cropping, framing or appearance may also occur because of production methods, natural materials and the individual characteristics of artworks.
Reasonable variations of this nature are not necessarily defects. This does not limit any rights available to you where goods are faulty, materially misdescribed or otherwise fail to meet applicable consumer guarantees.
We do not guarantee that the appearance of a product on your screen will exactly match its appearance in person.
Product descriptions, prices, specifications and availability may be changed at any time without notice.
We reserve the right to discontinue products or limit product quantities, sales regions or availability on a case-by-case basis.
Some products may be original, limited edition, made to order, specially finished, framed, personalised or produced to customer specifications. Relevant conditions will be stated on the applicable product page.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase the selected products under these Terms.
An order is not accepted until we confirm acceptance and successfully process the required payment.
We reserve the right to accept, decline, limit or cancel an order where reasonably necessary, including where:
• A product is unavailable
• Pricing or product information contains an error
• Payment cannot be authorised
• We reasonably suspect fraud or unauthorised activity
• Delivery is unavailable to the supplied address
• The order breaches these Terms
If we decline, change or cancel an order, we will attempt to contact you using the email address, billing address or telephone number supplied with the order.
Please review your order carefully before submitting it. Changes or cancellations may not be possible after production, customisation or fulfilment has begun.

Unless expressly agreed otherwise, products purchased through the store are intended for personal or household use and not for unauthorised commercial resale.
SECTION 4 — PRICES, TAXES AND BILLING
Prices, discounts and promotions may change without notice.
The price charged will be the price displayed when the order is submitted, subject to correction of genuine errors.
Unless expressly stated otherwise, displayed prices may not include shipping charges, handling fees, customs duties, import taxes or other government charges.
Applicable charges will be shown at checkout where they can reasonably be calculated.
International customers may be responsible for duties, taxes, customs fees or processing charges imposed by the destination country.
Prices displayed on this website may differ from prices available through third-party marketplaces, galleries, physical locations or promotional channels.
You agree to provide current, complete and accurate billing, payment and account information.
You represent and warrant that:

• Charges incurred through the order will be honoured
• You will pay all applicable product, shipping, tax and other disclosed charges

SECTION 5 — SHIPPING AND DELIVERY
Processing and delivery timeframes shown on our website are estimates unless expressly stated otherwise.
Delivery may be affected by carrier delays, customs processing, weather, peak-season demand, production requirements and circumstances outside our reasonable control.
Where tracking is available, tracking information will normally be sent after dispatch.
Items within one order may be produced or delivered separately and may have different tracking numbers.
If an order is delayed, damaged, lost or incorrectly delivered, please contact us so that we can investigate and provide an appropriate remedy where required.
Customers are responsible for providing a complete and accurate delivery address. Additional delivery charges may apply where a parcel must be redirected or resent because of an incorrect or incomplete address supplied by the customer.

Nothing in this section excludes, restricts or modifies any right or remedy available under the Australian Consumer Law or any other applicable consumer protection law.
SECTION 6 — INTELLECTUAL PROPERTY
The Services and their contents—including trademarks, brand names, logos, text, product descriptions, photographs, artwork images, graphics, illustrations, layouts, videos, audio, reviews and website design—are owned by Coastal Art Life, its affiliates, artists, suppliers or licensors.
These materials are protected by applicable Australian and international copyright, trademark and other intellectual property laws.
You may access and use the Services for personal, lawful and non-commercial purposes only.
Unless expressly authorised in writing, you must not:
• Reproduce, copy or republish website content
• Download or distribute artwork images for commercial use
• Modify or create derivative works from protected materials
• Publicly display or commercially exploit website materials
• Remove copyright, trademark or attribution notices
• Use our images, artwork or designs to train, develop or operate commercial artificial-intelligence systems
• Use our trademarks, brand names or logos in a misleading or unauthorised manner
No provision of these Terms grants you ownership of, or a licence to use, intellectual property belonging to Coastal Art Life, Shopify, an artist, supplier or third party except where expressly stated.
Unauthorised use may violate applicable intellectual property and other laws.
“Coastal Art Life”, associated logos, product names, designs and slogans are trademarks or protected brand assets of Coastal Art Life or its licensors.
Shopify’s names, logos and associated brand assets are owned by Shopify. Other brand names and trademarks belong to their respective owners.
SECTION 7 — OPTIONAL TOOLS
We may provide access to tools, integrations or services supplied by third parties.
We do not necessarily monitor or control those tools and provide access to them on an “as available” basis.
Your use of optional third-party tools is at your own discretion and may be subject to the provider’s separate terms and privacy policy.
To the extent permitted by law, we are not responsible for loss arising solely from your use of an optional third-party service outside our reasonable control.
New website features, tools or resources introduced in the future will form part of the Services and will be subject to these Terms.

Coastal Art Life is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are transactions directly between you and Coastal Art Life.
Shopify is not the seller of our products and is not responsible for the fulfilment, quality, delivery or suitability of products purchased from Coastal Art Life.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from transactions between you and Coastal Art Life.
Nothing in this section affects any non-excludable rights you may have under applicable law.
SECTION 10 — PRIVACY

This licence does not transfer ownership of your Feedback to us.
You represent and warrant that:
• You own the Feedback or have permission to provide it
• Your Feedback is accurate to the best of your knowledge

• Your Feedback does not contain malware or harmful code
We are not required to keep Feedback confidential, compensate you for it or respond to it unless otherwise agreed.

The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, dimensions, availability, pricing, promotions, shipping charges or delivery estimates.
We may correct errors, update information or cancel affected orders where reasonably necessary.
If an order is cancelled because of an error, any amount paid for the cancelled item will be refunded.

An Agent must not access or interact with the Services where we have expressly requested that it cease doing so.

• Payment obligations remain outstanding

Termination does not affect rights or obligations that arose before termination.
Provisions that by their nature should continue—including those concerning intellectual property, privacy, liability, indemnification and governing law—will survive termination.

To the maximum extent permitted by law, Coastal Art Life and its directors, officers, employees, affiliates, contractors, agents and service providers will not be liable for indirect, incidental, special or consequential loss arising from use of the Services where that loss was not reasonably foreseeable.
Nothing in these Terms excludes liability for fraud, wilful misconduct or any liability that cannot lawfully be excluded.
Where liability cannot lawfully be excluded, it will be limited only to the extent permitted by applicable law.
Nothing in this section limits any right or remedy that cannot be limited under the Australian Consumer Law or other applicable consumer protection legislation.
SECTION 18 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Coastal Art Life, Shopify and their respective affiliates, officers, directors, employees, contractors, agents, licensors and service providers against third-party claims, losses, liabilities and reasonable legal costs arising directly from:
• Your material breach of these Terms
• Your unlawful use of the Services
• Your infringement of another person’s rights
Your obligations will be reduced to the extent that an act or omission of Coastal Art Life contributed to the relevant loss.
We will provide reasonable notice of an indemnified claim where practicable and may control its defence and settlement.
We will not agree to a settlement imposing a non-monetary obligation on you without your reasonable consent.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the maximum lawful extent or severed where necessary.
The remaining provisions will continue in effect.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
A failure or delay by us to exercise a right does not constitute a waiver of that right.
These Terms, together with policies and rules incorporated by reference, constitute the entire agreement governing your use of the Services and supersede prior communications concerning the same subject matter.
Nothing in this section excludes representations or rights that cannot lawfully be excluded.
SECTION 21 — ASSIGNMENT
You must not assign or transfer your rights or obligations under these Terms without our prior written consent.

These Terms and any separate agreements through which we provide the Services are governed by the laws of Queensland, Australia and the applicable laws of the Commonwealth of Australia.
Subject to any mandatory consumer rights or jurisdictional requirements, the parties submit to the courts of Queensland, Australia and courts entitled to hear appeals from them.
Nothing in this section prevents a consumer from exercising rights available under mandatory laws applying in their place of residence.

Changes will apply from the effective date stated in the revised Terms and will not retrospectively remove rights that have already accrued.
Continued use of the Services after revised Terms take effect constitutes acceptance of those changes, except where applicable law requires another form of consent.
SECTION 25 — AUSTRALIAN CONSUMER LAW
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
Where a product has a major failure, you may be entitled to reject the product and choose a refund or replacement, subject to applicable law.
Where a failure is not major, we may be entitled to provide an appropriate remedy within a reasonable time.
